A return to Europes top competition will likely be the priority, followed by a desire to play the kind of attacking, dynamic brand of football expected at United but unable to be delivered by Moyes. United has broken the mould by appointing Van Gaal. In the clubs 136-year history, no previous manager has come from outside Britain or Ireland, a common occurrence at Englands other big clubs in recent years. The notion of United hiring coaches in a bid to create a dynasty -- something Ferguson uniquely achieved -- also appears to have ended. After spending six years at Ajax, where Van Gaal guided a talented young team to the pinnacle of European football by winning the Champions League in 1995, he joined Barcelona in 1997 for the first of two spells -- the first lasting three seasons and the second barely half a year. He has since coached AZ Alkmaar in the Dutch league and Bayern between 2009-11. So he may not be the long-term manager many at United crave -- Giggs, Uniteds interim manager for last seasons final four games and one of the clubs greatest players, is thought to be being groomed for the seat in the future -- but the fact that Van Gaal has won league titles with every team he has worked makes him one of Europes most-respected coaches. In his closing argument on Thursday, Prosecutor Gerrie Nel accused Oscar Pistorius of engaging in a "snowball of lies" that ultimately was so absurd that it degenerated into a "farce". Rickey Henderson Jersey . We know that Pistorius has admitted to killing Reeva Steenkamp. The issue being determined at trial is whether he intended to kill her, or as Pistorius alleges, did so by accident. Murder vs. Culpable Homicide The two main charges at play are murder and culpable homicide. In order establish murder, the prosecution needs to show that Pistorius intended to kill Steenkamp. If the prosecution fails on murder, they can still get Pistorius on culpable homicide. This charge means that Pistorius negligently killed Steenkamp. And this is what Pistorius is alleging - he killed Steenkamp by accident. He thought she was an intruder. Remember this critical point: Pistorius can still be convicted of murder if it can be shown that he intended to kill - period. It doesnt matter who - just that he intended to kill someone and that the force he used was disproportionately excessive given the circumstances. Prison Time Murder would result in a compulsory sentence of 15 years in prison. For culpable homicide, the sentencing is discretionary (varies from fines to prison time), although its not unusual to see prison time in South Africa of 5-10 years for this type of crime. The prosecution did charge Pistorius with premeditated murder, which means they are alleging he not only intended to kill Steenkamp, but he planned it out beforehand. With that comes a compulsory life sentence. The problem here for the prosecution is that you need a robust planning element to make out this charge and thats not present here. Rather, this looks like a domestic dispute gone tragically wrong. Nel covered a lot of ground on Thursday in his summation. Here are some of the key moments. Pistorius: A Tale of Two Defences Nel accused Pistorius of having "two defences you can never reconcile". In an earlier version, Nel noted that Pistorius said he "fired" at the toilet door in self-defence, which is evidence of intent (or murder). As well, right after he killed Steenkamp, Pistorius told people that he thought she was "an intruder" but never claimed he shot accidentally. However, later on in his testimony, Pistorius shifted his defence, arguing that he fired by accident. So when Pistorius said he "didnt intend to shoot anyone" and the discharge was an "accident", he was trying to show he lacked the requisite intent for a conviction of murder. For this reason, Pistorius testified that he never "aimed" his gun at the door, but rather the gun was merely "pointing" at the door when it went off by accident. While the difference between the words "aimed" and "pointing" may seem insignificant, in the context of this case they are absolutely key. "Aiming" suggests intent while "pointing" is designed to support the accidental shooting defence. So yes – Pistorius chose his words very carefully. Its tough to believe he fired the gun by accident. He went into a dangerous situation with his firearm, disengaged the safety, proceeded down the hallway to the bathroom in a tactical manner and didnt yell out or fire a warning shot so as to avoid alerting the "intruder" to his presence. However, once facing the bathroom door, he suddenly panicked and accidentally fired four shots in quick succession. Effectively, Pistorius is seeking to convince the Court that all his decisions were conscious and intentional up until the point he was facing the bathroom door, at which point he became unhinged and lost himself. Pistorius Screams Like A Woman In his closing, Nel also noted that Pistorius promised to call a witness to prove that he "screams like a woman". The prosecution called a number of witnesses, including Michelle Burger, Charl Johnson, Dr. Johan Stipp and Estelle van der Merwe, who testified that the lights were on and they heard arguing and screaming. Stipp recounted that he heard female screams that sounded like a woman "scared out of her mind." Burger described female screams as "petrifying" and added this: "I was sitting in bed and I heard her screams," Burger testified. "She screamed terribly and she yelled for help. I heard the screams again. It was worse. It was more intense. Just after her screams, I heard four shots. Four gun-shots... You could hear it was blood curdling screams. You cant translate it into words. The anxiousness in her voice, and fear. It leaves you cold. She screamed terribly and she yelled for help". Pistorius repeatedly alleged that he screamed like a girl. However, little in the way of compelling evidence supporting his position was presented and Nel reminded the Court of that. Steenkamp Facing the Bathroom Door In his closing, Nel argued that Steenkamp was "standing facing the accused" behind the locked bathroom door when she was killed. This is also essential to the prosecutions case. Earlier in the trial, Ballistics Expert Captain Christian Mangena testified that Steenkamp was facing the door when she was shot (rather than with her side facing the door). The first shot hit her in the right hip. The shot broke her hip and threw her back onto a magazine holder. She then assumed a defensive position by crossing her arms over her head. The second shot missed but broke into fragments and bruised her back. The third shot hit her in the right arm, which in the opinion of the expert, supports the conclusion she was shielding herself from fire. The fourth shot hit her in the head, killing her almost instantly. For the prosecution, this helps establish that Steenkamp was in the bathroom hiding from Pistorius when she was shot. If she had simply gone to the bathroom, it would have been more likely that she would not have been facing the door as she was. Steenkamp Brought Her Phone To The Bathroom and Locked The Door Nel reminded the Court that at 3am, Steenkamp took her cellphone to the bathroom and locked the door. The implication is clear: it is highly unusual for someone to take their phone to the bathroom in the middle of the night and lock the door unless they feel threatened. As Nel stated on close, "why would she find herself locked up in the toilet if there was no intruder?". Steenkamp Had A Late Meal During his close, Nel also submitted that Steenkamp consumed food about two hours before her death. According to Pistorius, the couple was in bed by 10pm. This statement was designed to counter witness testimony that the couple was up arguing very late. However, pathologist Professor Gert Saayman testified that food found in Steenkamps stomach suggested she ate within two hours of her death shortly after 3am. Nel also focused on other inconsistencies with Pistoriuss story. How did he not know Steenkamp was not in bed when he walked right by her? Wouldnt Steenkamp have yelled in the bathroom after the first shot was discharged? Why not direct her to safety before confronting the mysterious intruder? Overall, there are a number of improbabilities with Pistorius story. While each piece of evidence when considered in isolation may be insufficient to result in a murder conviction, when viewed in their totality, the evidence conspires to tell a story of a domestic dispute turned tragic. With all the complex evidence before the Court, one simple piece continues to stand out: who goes to the bathroom at 3 oclock in the morning with their cellphone and locks the door? Historically, arbitrators dont like to see punishments or sanctions that seem to be a dramatic departure from the existing rules and policies at play. So are you saying that A-Rods suspension could have been reduced by a lot more? Yes. The collectively bargained Drug Policy provides for a 50 game suspension for a first time offender like him, and as a result his 211 game suspension may have been found to have been not only excessive and heavy-handed, but also not in keeping with the Drug Policy. The Drug Policy calls for a specific punishment for a first time offender, and that punishment was ignored in favour of a far longer suspension. If that argument got any traction, the arbitrator could have reduced the suspension by many more games. So why didnt the arbitrator reduce the suspension by more games? He was convinced that a substantial suspension was warranted. Based upon what we know about this case, MLB argued that A-Rod had engaged in an extensive and continuous pattern of PED use since at least 2010. He also has a long standing relationship with Biogenesis founder Tony Bosch that dates back to 2009. MLB also alleged that A-Rod obstructed its investigation, tampered with witnesses and generally interfered with its attempt to get to the truth. MLB has also suggested that A-Rod may have also recruited players to Biogenesis. Ultimately, his pervasivve and wide ranging pattern of wrongdoings was not only contrary to the Drug Policy, but also the MLBs Basic Agreement, which allows baseball to discipline a player for conduct detrimental to the game. So given these various factors, A-Rods suspension was reasonable in the eyes of the arbitrator. So all of these elements conspired to result in only a modest reduction in the suspension. Was this ruling predictable? Yes. A-Rod filed his lawsuit against the league (and also personally against Commissioner Bud Selig) months ago in anticipation of being in a position to challenge the whole Biogenesis investigation and suspension. The first thing he does is ask a judge to put the suspension aside until such time that the case is decided in a court of law (which could take years thereby allowing A-Rod to play out his contract). A-Rod is unlikely to be successful with this request since this type of relief is only awarded in very special circumstances; and this isnt one such case on its face. Horowitz is a seasoned and respected arbitrator, and a court will defer to him.  Right now, MLB is trying to have the case kicked out of Court, while A-Rod wants it moved to state court. It would be a surprise to see a judge kick the case out of court completely; still A-Rod faces challenges. Enough Jibber Jabber. Can A-Rod win in Court? Probably not. Heres your bottom line: judges are very reluctant to overturn arbitrators unless their decisions are off the wall. The reasoning is this: arbitrators are specialists on the issues they rule on and judges are not in a better position to decide these cases. Also, judges want people to respect arbitration and take it seriously. If they didnt, the lines at the court house would be a lot longer. Apart from being a partner at a law firm, Im also an arbitrator. When Im making my rulings, I know that unless Im totally out in left field, my decision will stand if challenged in court. So A-Rod has a real uphill battle ahead of him. The likelihood of success seems low. However, A-Rod may still pursue it and this could go on for years. Anything else I should know about? One small thing: Federal law enforcement officials are investigating Biogenesis raising the possibility of criminal charges. If that happens, expect the feds to have A-Rod testify under oath. At that point, he would be advised that he needs to tell the truth, failing which he could face perjury charges.  This is quite the mess. Yep. ' ' '

"Im not coming in with a five-point plan," Silver told The Associated Press during an interview in his office at NBA headquarters. "Im not an outsider coming into the league. Ive been part of this league for a long time and if there was something that I thought shouldve been done markedly different than the way its done now, I think David and I would have pushed each other to do it. "My priority is the game and thats what Ill be telling people next Saturday." He has been at the NBA since 1992, overseeing the leagues entertainment empire, helping negotiate collective bargaining agreements, and on Feb. 1, he replaced Stern. He is liked by owners and respected by players, all believing Silver is the person to continue the massive growth the league saw under Stern. "It never even was a consideration of working at the NBA," Silver said. "I dont think I understood what that meant. I truly stumbled into working at the NBA." Silver began his career in the legal field but was interested in transitioning to business, the same move Stern had so successfully made. So he wrote to Stern, who had worked at the same firm where Silvers father, Edward, was a lawyer. Silver had handled some media cases and was aware of Sterns accomplishments in negotiating cable TV deals. Stern gave him the number of someone to call, but the job was outside New York. Silver wasnt interested in moving, which he explained to Stern when they spoke again. "He said, Why didnt you tell me? Ive got some other ideas," Silver said. "It was happenstance," he added. "I dont think I quite understood what I was getting into at the time." He doesnt plan on changing much, insisting that he and Stern would have already made whatever changes they felt necessary. But while the NBAs international growth is frequently considered Sterns greatest achievement, Silver seems focused on boosting the games popularity in the United States. Silver has always been ahead of the curve when it comes to basketball. He attended Duke in the early 1980s before the Blue Devils became a powerhouse, when nobody camped out outside Cameron Indoor Stadium because you could just get into games with a student ID.
